Factual Data is a reseller of consumer reports. A “reseller” is a consumer reporting agency that (1) assembles and merges information contained in the database of another consumer reporting agency or multiple consumer reporting agencies concerning any consumer for the purposes of furnishing such information to any third party, to the extent of such activities, and (2) does not maintain a database of the assembled or merged information from which new consumer reports are produced. As such, we may not have information on a particular individual solely because we are a reseller.

For example, the California Consumer Privacy Act FAQs posted on the CalPrivacy website specifically provide as follows: “Why is a credit reporting agency still giving out my credit information even though I asked it to delete my information? Credit reporting agencies … can still collect and disclose your credit information, subject to regulation under the Fair Credit Reporting Act.”

As such, we cannot process requests to delete or erase your personal information in a consumer report or in an identification information product that we previously provided to a Factual Data customer.
